This is where the two original Enduring Powers of Attorney comes into play. Both original signed, witnessed and accepted Enduring Powers of Attorney are lodged at Landgate. Both are registered by Landgate. One Enduring Power of Attorney is held by Landgate for their records and the other bound copy registered original Enduring Power of Attorney is returned to you.
If you only anticipate using your Enduring Power of Attorney for banking transactions and various financial, government, health fund and utilities queries then there is no need to lodge your documents at Landgate.
Lodgement of your Enduring Power of Attorney at LANDGATE should preferably be done within 3 months of signing. The cost is $187.60 – fee payable to Landgate.
