Instructions for signing your Enduring Power of Attorney
You must have two witnesses who are present at the same time to witness your Enduring Power of Attorney. Legislation states that ONE of the witnesses of your Enduring Power of Attorney must address the criteria of people authorised to witness a statutory declaration e.g. Pharmacist, Doctor, Engineer, Public Servant, Teacher, etc. The other witness can be any other person over 18. - Firstly, please remember to date your document.
- Sign your Enduring Power of Attorney in the presence of two appropriate witnesses:
- REMEMBER legislation states that ONE of the witnesses of your Enduring Power of Attorney must address the criteria of an authorised person to witness a statutory declaration, e.g., Pharmacist, Doctor, Engineer, Public Servant, Teacher, etc.
- the other witness does not have to meet statutory declaration criteria but must be over the age of 18, and BOTH WITNESSES MUST BE PRESENT AT THE SAME TIME TO WITNESS YOUR SIGNATURE.
- The reverse side of your Enduring Power of Attorney must be signed and dated by your attorney/attorneys accepting their appointment. This does not have to be witnessed.
